Deed Restrictions

deed restrictionsPlease be aware that lots within our neighborhood are generally governed by deed restrictions that often are more restrictive than the city's zoning standards. It is the responsibility of the property owner or developer to research existing deeds prior to new construction or remodeling. A violation of these restrictions may result in unnecessary costs or delays due to legal action. Generally, deed restrictions within the neighborhood cover:
• Front, rear and side setbacks of primary structure as well as detached garage.
• Building height (including garages).
• Open space coverage.
• Fencing (varies by Deed yet usually no higher than 2 Ft in the front setback).
• Size of construction or development signs placed in yard.

Grubb Properties

Grubb Site PlanCity Council will hold a Public meeting on March 19th to hear comments from the public on Grubb Properties plans to revise their site plan for Tract 3 at The Morrison (the mixed use project located at Colony and Sharon). Tract 3 is a 7- acre parcel located behind EarthFare abutting Sharon Rd and Morrocroft Lane. The proposed revision would allow the developer to convert previously approved 195 residential units to a continuing care retirement center and expand a previously approved fitness center from 10,000 to 30,000 square feet. The proposed site plan amendment also would allow for 20,0000 additional ground floor commercial uses (single user being no larger than 8,500 sq. feet) along Sharon Road and in the interior of the property.

The height of the retirement center will be staggered (3 stories, 5 stories and 10 stories) and may not exceed 120 ft (approximately 10 stories). Units that back up to Morrowcroft Lane shall be single family or duplex units.

As part of the project, the Developer will be required to help fund some additional pedestrian amenities along Sharon or Colony Road. For additional information regarding this site plan amendment request, click here.

 

Whole Foods Project

Although the media keeps reporting that Whole Foods intends to open (at the corner of Colony and Sharon) in 2009, we have not received official notice of their rezoning request. We will continue to monitor this project and keep residents updated as soon as we hear anything more.

Briar Creek Sewer Project

Briar Creek MapConstruction Update: Colony Road Work Schedule Change

Charlotte-Mecklenburg Schools were closed Monday, Feb. 1 due to snow. CMS students will make up this snow day Monday, Feb. 15, or Presidents' Day. Because of this, the contractor did not close and cross Colony Road that weekend, as previously scheduled. The Colony Road work has been rescheduled for the week of Spring Break, Friday, April 2 - Friday, April 9. Our goal is to close the road for only a portion of the week. More information will be sent once the work dates and the road closing are finalized.

Ghazi Rezoning

Ghazi Project (rezoning petition #2007-053), located at the corner of Fairview Road and Wintercrest Lane

Where the project stands:

  • A revised Ghazi project was approved on 7/2/07. Due to strong opposition from residents, the project's height was reduced from 22 stories to 10 stories.
  • The 3 acre site will be developed for luxury condominiums scattered in 3 buildings with staggered heights of 10, 6 and 3 stories.
  • Construction will begin late 2008.
